Our practice exists to assist borrowers quickly with short term, urgent opportunities that involve real property assets and to help smaller developers become large ones.

Our Commitment
At Unley Capital Partners we recognise that your privacy is important. We are committed to the highest standards in relation to the collection, use, accuracy and storage of your private information. We are bound by the Privacy Act 1988 which contains 13 principles known as the “Australian Privacy Principles”. Our main purpose for collecting personal information is to facilitate a private lending arrangement or non-consumer credit loan facility, and to update our records. At or before the time we collect personal information from you we will take reasonable steps to inform you why we are collecting that personal information, who else we might disclose that personal and or business information to and what may happen if you do not provide personal information to us.

Use and Disclosure
We may be subject to certain legislative and regulatory requirements that necessitate us obtaining and holding detailed information that personally identifies you and/or contains information or an opinion about you. In addition, our ability to provide a service is dependent on us obtaining certain personal information about you, including:

  1. Commercial credit information to assess an application for consumer credit or commercial credit

  2. Consumer credit information about me/us to assess an application for commercial credit

  3. A credit report provided by a credit reporting agency to collect information about financial performance.

  4. Providing information to a mortgage insurer to assess the risk of providing mortgage insurance or to assess the risk of default.

  5. Exchange of information between credit providers (including without limitation any other credit provider who has lent money on the same security) any information about credit worthiness, credit standing, credit history or credit capacity.

  6. Exchange of information with advisers and use or give to any broker, financial consultant, accountant, lawyer, or other adviser acting in connection with any financing provided or proposed to be provided to you for commercial credit information.

  7. Give to a credit reporting agency personal or commercial information about you. The information may include identity particulars; the fact that credit has been applied for and the amount: the fact that the Lender is a current credit provider; payments which become overdue more than 60 days, and for which action is commenced; advice that payments are no longer overdue; advice that cheques drawn have been dishonoured more than once; in specified circumstances that in the opinion of the Lender you have committed a serious credit infringement; and the credit provided to you by the Lender has been paid or otherwise discharged.

  8. Disclose any report or personal information about you to another person in connection with funding financial accommodation by means of an arrangement involving securitization.

  9. Provide information to Guarantors Provide information to any person who proposes to guarantee or has guaranteed repayment of any credit provided to you.

  10. Provide information to effect or renew insurance of the security property.

  11. Provide information to other interested party(s) such as a Lender and or Investor considering this loan application. Unless you advise the Lender in writing not to, otherwise the Lender may transfer to, for use by any other Unley Capital Partners associated company, any personal, consumer or commercial credit information provided by you to the Lender (including but not limited to you name, address, age and telephone number, the type of product/s you have with the Lender, a summary of any transactions between us from time to time which may include details of the loan term, the principal drawn-down, the account balance and repayment amounts). You understand that the purpose for which the Lender may transfer this information will be for the marketing, planning, product development and research requirements of the Lender and any other company within Unley Capital Partners.

  12. You consent to your identification information being verified with the Issuer/Official Record Holder e.g. through Equifax ID Matrix DVS/AML services

As we operate throughout the world, some of these uses and disclosures may occur outside Australia. We may use the personal information collected from you for the purpose of providing you with direct marketing material such as articles that may be of interest to you. You may, by contacting us by any of the methods detailed in this policy statement, request not to receive such information and we will give effect to that request. Please allow two weeks for your request to be actioned.

Data Quality
We will collect sufficient information to ensure appropriate service delivery. If you elect not to provide us with sufficient information or that information is incorrect we may decline to assist you with any services and or you may be subjected to penalties as defined by the commercial agreements you are a party to.

Data Security
We take reasonable steps to protect the information we retain from misuse, loss and from unauthorised access, modification or disclosure. We will not retain any of your information for any longer than it is required by us, except to satisfy legal requirements. We will destroy or de-identify your personal information when it is no longer required.

We may use and disclose personal information for the purposes for which it was provided or secondary purposes in circumstances where you would reasonably expect such use or disclosure. We may disclose personal information to third parties or external contractors carrying out functions and duties for and on behalf of Unley Capital Partners Pty Ltd. It is a condition of our agreement with each of our external contractors that they adopt and adhere to this privacy policy. The information we collect from you may also be disclosed to third parties if the disclosure is required by or permitted by law. In the event that we propose to sell our business we may disclose your personal information to potential purchasers for the purpose of them conducting due diligence investigations. Any such disclosure will be made in confidence and it will be a condition of that disclosure that no personal information will be used or disclosed by them. In the event that a sale of our business is affected, we may transfer your personal information to the purchaser of the business. As a client you will be advised of any such transfer.

Access and Correction
You may access the personal information we retain and request corrections. This right of access is subject to some exceptions allowed by law. We will not provide you access to personal information which would reveal any confidential formulae or the detail of any in-house evaluative decision making process, but may instead provide you with the result of the formulae or process or an explanation of that result. Unley Capital Partners Pty Ltd reserves the right to charge a fee for searching for and providing access to your personal information. In the event we refuse you access to your personal information, we will provide you with an explanation for that refusal. We will endeavour to ensure that at all times the personal information about you that we hold is up to date and accurate. The accuracy of the personal information is dependant to a large degree on the information you provide and you should advise us if there are any errors in your personal information.

In some circumstances we are required to collect government identifiers, for example, your Tax File Number. We will not use or disclose this information other than when required to do so by law or, when consented to by you.

You may deal with us anonymously where it is lawful, practicable and reasonable to do so.

Sensitive Information
Without your consent, for example where information is provided by you for insurance and or risk purposes, we will not collect sensitive information about you. Exceptions to this include where the information is required by law, or for the establishment, exercise or defense of a legal claim.
